Fraud follows a case of mistaken identity

Three people with the same name, living in the same road, led to a woman cashing a cheque for £900 intended for another.

Denise Miller, 29, of Aspal Place, Beck Row, received and cashed a cheque for £943.20, intended for a Mr D Miller, before withdrawing the money.

The court heard the defendant had been married to another Mr D Miller, however the pair had separated three weeks prior to the arrival of the cheque.

Miller pleaded guilty to fraud by false representation at Bury St Edmunds Magistrates’ Court on Tuesday and was discharged conditionally for one year.

Alison Armstrong, in mitigation, said: “It was sent in error to the wrong address five doors down - the cheque said to another D Miller living on the same road.”

The defendant banked the cheque in her husband’s name and ‘thought nothing of it’, the court heard.

District Judge, Celia Dawson, said that the cheque had been sent in error, that the defendant had not been ‘deliberately dishonest’ and accepted that she should have made further inquiries.

She said: “If something seems to be too good to be true, it probably is too good to be true.”

As well as receiving a conditional discharge for one year, Miller was told to repay the £943.20 at a rate of £40 a fortnight.
