Bury St Edmunds lorry driver who breached rest rules is fined and could face HGV ban

A lorry driver who worked for seven consecutive days, breaching rest rules has been fined £1,000 and told to pay £1,000 in court costs.

Timothy Boyden from Bury St Edmunds could also been banned from driving HGVs by The Traffic Commissioner, town magistrates heard.

The 38-year-old of Brockesby Walk, lost his Monday to Friday job with BOCM Pauls at the Rougham Industrial Estate, after it was revealed he was also working weekends as a ‘casaul’ drive for TM Transport in Sudbury.

Boyden told VOSA investigators he carried out the work to clear his credit card debts,

But presiding magistrate Alan Humphreys said in doing so he had put the lives of others at risk.

“That is the law and it protects other road users. We see so many times the effects of tired drivers,” said Mr Humphreys.

Boyden had admitted a total of seven charges two for not taking his rest periods and five for not telling his employers that he had not taken the statutory rest.

The charges related to dates in August and September last year.

Dave Foulkes, prosecuting said the offences came to light the following month.

He said the law states that lorry drivers have to take 24 hours rest following six days of working.

“He was driving for longer periods than he should have done,” said Mr Foulkes.

“When people are driving heavy goods vehicles there are potential consequences of driving to other road users by breaching regulations in this way.”

Mr Foulkes told Thursday’s hearing at Bury magistrates court, that Boyden had been earning £120 per shift for the weekend work with TM Transport.

Murray Oliver in mitigation said the charges related to two occassions where Boyden had breached the rest rules.

“It was in order to try to deal with some credit card debt which had got a little bit overwhelming,” Mr Oliver said.

“Mr Boyden realises this is not the sort of behaviour expected of him as a professional driver.”

He said the work for TM Transport had involved driving goods from a factory to the other side of the road, before taking the lorry back to a tra nsport yard two miles away.

He added the Traffic Commissioner could now ban Boyden from driving HGVs.
