Motorist did not see biker – court

A driver, who collided with a motorcyclist on the B1106 at North Stow, has been found guilty of driving without due care and attention.
Glenn Hussein, 46, was convicted of driving without due care and attention at Bury St Edmunds Magistrates' Court on Tuesday, having denied the offence following the incident on August 5 last year.

Kevin Jones, 30, was killed when his motorbike smashed into the side of Hussein's grey Peugeot car as he tried to turn into the King's Forest picnic site.

Speaking at his trial, Hussein, of Raynham Road, Bury, said: "I have questioned myself time and time again. There was nothing I could do. He was very very fast."

Hussein claimed he had virtually stopped and double checked the road was clear before turning across the south-bound carriageway to collect his wife from the site.

Although paramedics treated Mr Jones, of Hales Barn Road, in Haverhill, he was pronounced dead at the scene.

Pc Adam Williams, a police witness who conducted a forensic reconstruction of the incident, told the court Mr Jones would have been in sight for around 10 seconds before Hussein made his turn.

He said: "At the moment Mr Hussein began to turn the Peugeot, the motorcycle was able to be seen.

"I am unable to say whether Mr Hussein looked and didn't see or if he didn't look, but it was available to be seen."

Speaking in his own defence, Hussein said he had been travelling at around 40 to 50 miles an hour when the collision happened at noon on the day in question.

Hussein, a media salesman who drives up to 30,000 miles a year, said he had taken all possible precautions before making the turn.

In an interview read in court, Hussein said: "As I pulled into the entrance, he came out of nowhere and hit straight into me.

"There was nothing there and then there was."

Hussein was issued with nine penalty points and a £500 fine, charged £450 costs and a £15 surcharge.

Presiding magistrate Meg Clibbon said a competent driver would have been able to see the motorcyclist.

She said: "By your own admission, you knew this road was fraught with hazards.

"You didn't take sufficient notice of this before making your turn."
